  • Is listed as significant under a Development Control Plan (DCP) or Local Environmental Plan (LEP)

  • Is native and exceeds size thresholds set by council

  • Provides habitat for protected wildlife species

  • Is part of a bushland area, approved landscape plan, or riparian corridor


Common Exemptions


You may not need approval if the tree meets one or more of the following conditions:


  • It is dead, dying, or poses an immediate safety hazard

  • It’s a declared environmental weed, such as:

    • Camphor Laurel (Cinnamomum camphora)

    • Coral Tree (Erythrina crista-galli or Erythrina x sykesii)

    • African Tulip Tree (Spathodea campanulata)

    • Cocos Palm (Syagrus romanzoffiana)

    • Umbrella Tree (Schefflera actinophylla)

    • Cadaghi (Corymbia torelliana)

  • The property falls within a bushfire-prone zone, and removal is compliant with the NSW 10/50 Vegetation Clearing Scheme (NSW Rural Fire Service)


Even if you believe your tree qualifies for exemption, it’s strongly recommended to consult with a qualified arborist and document any advice or assessments in writing for future reference.
